Myself or a loved one has a Cash or Surety bond, what does that mean?

There are several types of bonds in the State of Missouri. The most common is a Cash or Surety bond. You have the option of posting the full amount in cash with the court, then you will receive this amount back, minus any court costs, once the court case is completely over. If you do not have the full amount in cash, you have an option to use a bail bondsman.

I have a $25,000.00 cash or surety bond, and I do not have the $25,000.00 in cash. Do I have to sit in jail until my case is over?

No. You can use a bail bondsman to get out of jail. The typical premium (fee) is 10% of the bond (in this case, $2,500.00). You do not receive any of the premium back when the court case is over.

I have a $10,000.00 cash or surety bond. I do not have $10,000.00 cash, but I do have $1,000.00. What do I do next?

I have been asked to cosign on a bond for a family member, is there any risk in this?

Yes. You are liable for the full bond amount if the defendant does not make all court appearances. If you believe the family member will make all court appearances, then your risk is low. If you believe the defendant is a flight risk, tell the bondsman, and refuse to cosign.
